EXPUNGING / VACATING CONVICTIONS, SEALING RECORDS, AND RESTORING FIREARM RIGHTS
The Howson Law Office represents individuals who wish to vacate convictions, seal Juvenile Court records, and/or restore firearm rights for matters which occurred in Skagit County Washington. “Vacating” a conviction is sometimes referred to as “expunging.”
Not all convictions can be vacated and not all people are eligible to vacate a conviction, seal a record, or restore firearm rights, so it is first necessary to determine a person’s eligibility. Once it has been determined that the person is completely eligible to apply for the requested relief, a petition is created with a certification (sworn document) to be signed by the client. The matter is then set for hearing.
NOTE: Convictions for Sex Offenses, Class “A” felonies, or for DUI may not be vacated. However, an offense reduced from a DUI such as Negligent Driving in the First Degree may be vacated after 10 years. There are certain other offenses which also may not be vacated.
Firearm Rights may not be restored if the conviction was for a Class “A” felony or for a “Sex Offense.”
